The prohibition finally reaches the marketing of cosmetic tested on animals in Europe, thanks to the sentence of the Court of justice of the European Union. The association of British category of the manufacturers of ingredients for cosmetic products in the UE, European Federation for Cosmetic Ingredients, has consecrated such prohibition turning to a British judge to understand if it penally were admissible, from three members of his, the immission in the United Kingdom of cosmetic products whose ingredients had been submitted out to animal experimentation some UE for the sale in China and Japan.

The sentence has clarified that "the immission on the European market can be also forbidden when such experimentations out of the UE have been conducted for allowing the marketing third countries and the result of such experimentations is used for proving the safety of the product." The Rule on the cosmetic 1223 of 2009, modified in July 2013, already affirmed in fact that "the product must be sure for the human health, and its safety must be valued on the base of pertinent information and to be object of a relationship included in the informative documentation on the product." The Court has confirmed that "the access to the market of the union is subordinate to the respect of the prohibition of animal experimentations" and that under this aspect it is "irrelevant the fact that the animal experimentations have been in demand to allow the marketing of the product in third countries because the right of the union doesn't operate any distinction in base to the place in which have been effected."

Adding that the European rule owes "to promote an use of alternative methods that doesn't involve the employment of animals to guarantee the safety of the products. The realization of such objective would be notably compromised if it were possible to elude the anticipated prohibitions from the right of the union effecting the animal experimentations in third countries." The right of the UE so definitely demolishes its territorial confinements and becomes ethical more and more.
